A demand letter is a written request, sent to the person who owes you something, to do it. In law the word that matters is delay, and Article 1169 of the Civil Code says when it starts. This 777JILI page reads that article and the Supreme Court’s small claims form, and it sits under the complaint letter pillar because a demand and a complaint share their first parts.

Article 1169 and what a demand changes

Article 1169 of the Civil Code says: “Those obliged to deliver or to do something incur in delay from the time the obligee judicially or extrajudicially demands from them the fulfillment of their obligation.” A letter you send is an extrajudicial demand. The article lists three cases where demand is not necessary:

  1. The obligation or the law expressly so declares.
  2. The designation of the time for delivery or service was a controlling motive for the establishment of the contract.
  3. Demand would be useless, as when the obligor has rendered it beyond his power to perform.

For reciprocal obligations the article adds that neither party incurs in delay if the other does not comply or is not ready to comply.

What the small claims form asks

The Supreme Court’s Rules on Expedited Procedures in the First Level Courts, A.M. No. 08-8-7-SC, include Form 1-SCC, the Statement of Claim. Three places in it touch a demand letter:

Place in the formWhat it prints
Item 4, “Demand for payment”“Did you ask the defendant to pay you before filing this case?” with Yes or No, and “If no, please explain.”
Proof-of-claim checklist“latest demand letter (with proof of delivery and receipt)”
Exhibit tick-box“Latest Demand Letter marked as Exhibit”

The form asks the question; it does not make a letter a precondition. For the court route itself, read the small claims filing steps.

What a demand letter holds

No saved law text prints a template for a demand letter, so wording is yours. The DTI’s e-Sigaw page on complaint letters lists parts that map onto one:

PartSource of the list
Names, addresses, e-mail and contact numbers of both sidesDTI e-Sigaw, complaint letter contents
Narration of factsDTI e-Sigaw
DemandDTI e-Sigaw
Proof of the transactionDTI e-Sigaw, and the small claims checklist
Proof of delivery and receipt of the letterSupreme Court, Form 1-SCC checklist

State the amount and the date by which you ask for payment, and keep the delivery proof.

What a demand letter does not do

Article 100 of RA 7394 gives a 30-day period for correcting an imperfection before the consumer may choose a remedy. That is a rule about product and service imperfections, and it is not a demand letter rule. A demand letter also does not take the place of a complaint to the agency that handles your problem, and it cannot promise that money comes back.

Example: a seller owes you a ₱5,000 refund, and you write on a set date asking for it within a stated number of days. The letter is your extrajudicial demand under Article 1169, and the receipt is your proof of delivery for Form 1-SCC.

Letters that only look like demands

A message that claims to be a subpoena or a settlement notice is a different matter. The PNP ACG’s notice on its own site describes an e-mail that gave 24 hours to choose a settlement or a trial, and says neither the PNP nor the PNP ACG sends legal documents via e-mail or requests money for processing settlements. It adds that its personnel and investigators communicate directly with complainants. The archived contacts are on the PNP ACG page.

Sending a demand: a short routine

  1. Write the letter with the parts in the table above.
  2. Send it by a way that gives a receipt, so the delivery proof exists.
  3. Keep a copy and the receipt together.
  4. If no answer comes, attach both when you file for small claims or a DTI complaint.
